Arrests Made in U.A. and Fridays Dumping Raw Sewage

We all knew for years that Fridays and the UA were dumping raw sewage right into the creek and did nothing to hook up to the sewage system. Now something is finally being done. Arrests and criminal charges for all involved!

Years ago local Gerritsen Beach hero Buddy Dewitt with local orginazations discovered that Fun Time USA, Fridays, and the UA theater ALL were not connected to the sewage system. He discovered that they were ALL dumping raw sewage right into the creek. That was years ago and the city demanded that they hook up to the sewage system.

Apparently they did not – and now DA Hynes announced 8 arrests and citations for the corporations involved.

Regal Entertainment Group; Craig Novoa; Knapp Street Bagels and its manager, Simon Shin; and Deauville Marina and its manager, David Matalon, all face charges related to dumping untreated human waste into Shell Bank Creek. Knapp Street Bagels, Shin, and TGI Friday’s and its landlord, Alex Spivak, are also charged with dumping untreated waste grease and oil into the creek.

The investigation began with complaints from residents, in 2009, of sewage and grease in Shell Bank Creek, which traverses the Sheepshead Bay and Marine Park neighborhoods near Gerritsen Beach and Plumb Beach, before emptying into Jamaica Bay and eventually, the Atlantic Ocean. In addition to bluefish, crab, striped bass and other fish, Shell Bank Creek is home to a marina with several house boats. The septic pipes from a nearby shopping center run along the creek’s bank, and if they leak, effluent runs directly into the waterway.

The area around the creek is not served by the New York City sewer system, and businesses operating there must maintain their own private wastewater lines, which connect to a city sewage treatment center nearby. However, beginning in 2003, the New York City Department of Environmental Protection served multiple notices on Craig Novoa, the Regal Entertainment Group manager responsible for the theater, that its sewer lines leaked and needed repairs.

The investigation revealed that, in spite of these notices, noxious odors, fecal matter and toilet paper from the movie theater’s septic system were present in the creek as recently as this year. Using green dye, investigators traced discharges from the movie theater’s septic system and determined that the dye entered Shell Bank Creek. Other businesses charged with using the damaged sewage pipes included Tae Young Deli Corp, known as Knapp Street Bagel, TGI Friday’s and 49 Holding Corp., known as Deauville Marina.

The case is being prosecuted by Environmental Crimes Unit Assistant District Attorney John Rudikoff and Bureau Chief John Holmes, and Assistant District Attorney Elizabeth Kurtz and Rackets Division Deputy Bureau Chief Jacqueline Linares. Michael Vecchione is Chief of the Rackets Division.

    So who gets locked up from DEP? Most of that mess is from them. Not saying Fridays, etc. Are right, but I believe majority of that waste is from DEP’s dumping over the years.

No arrests then? Is it that they weren’t connected properly and had leaks or was this willful direct dumping into the creek then? What is it now – is it leaks from improper maintenance or willful dumping directly into the creek? This is BIG news – where’s the mainstream media on this to embarrass these savages? Where’s our green mayor?

    Your “Green Mayor” is to busy stashing his green, in offshore bank accounts in the Cayman Islands and the Bahamas Some of us do get it, these are money people, and taking care of the right palms at City Hall will get the laws bent for you .Or at the least get the enforcement held up… In addition to the arrests they should force these buisnesses to close down forthwith,,until they comply with the enviormental regulations.. That way instead of a long court battle while they to operate and dump. They will comply pretty quickly if they want to stay in buisness…It should also be noted that TGI Fridays dumped tons of unapproved land fill into the Creek… They were supposed to remove it long ago… It is still there…..

      I agree, there should be a two staged approach. First they should make certain no one flushes a toilet or turns on a sink at these places until the problem is addressed. Then worry about who will be locked up and how much money they will be fined. All the arrests and fines in the world matter less than stopping this insanity ASAP. There will be years to figure out the legal end of this.

          And MEANWHILE, The Board of Elections just got huge 6-8% raises, bringing many of them up to 160,000/year. For what? My unions contract expired 10/2007 and we don’t dare ask for a new one in these fiscal times, told that we should be happy that we have jobs at all. But then again, none of us go to parties and functions with the Mayor.

    the sad part is that all of you are falling into this media propaganda. None of you have any clue what you are talking about. The pipe system was fixed years ago for a lot of money. Supposedly, they are just trying to build a case. The city is lost and have no clue who to blame so guess who they take in…the theater, the marina, the deli, and tgif. If anyone actually knew the area, they took in the guy that makes your bagel with cream cheese every morning at the deli. The guy doesnt even speak english nor runs the place. As for the landlord of Fridays…dude just bought the rights to the land 7 months ago. As for the movie theater manager….he was paying the bills for the repair. I believe Regal paid for the new pipping.

    All of this will come out.

      Maybe you’re right – it will all come out. One thing is for sure, if this is common practice into our waterways then people need to make this a more publicized issue – not less. So I’ll agree with you if by “Media Propaganda” you mean that whatever little coverage this IS getting, they’re not digging deeper into it and making it sound as if someone of real consequence and blame is paying the penalty.

      GB.net – can you dig up some of the facts as to whose actually getting arrested (is it the bagel boy?) and what the City’s official position is on this? Why can’t the City better secure, if not install these pipes for a fee?

    and there was always a pipe..you guys should do actual reporting. The pipe was apparenly leaking in 2003. The EPA got involved and told the area to fix it. They fixed it. It continued leaking a couple years later. They fixed it. It still leaked a lil. They fixed it. Then realized they had to replace the whole pipe…so they paid for a whole new piping system.

    Get all your facts straight. None of you work for any of the establishments. None of you work for any of the departments. You just read what your told and just believe what you see. So sad.

        They were told to fix it and they did. They kept fixing it and that will show in the court case. Even spending $2 million to fix it. Instead of the city sitting down with the people in charge of the pipes and saying wtf, we need to solve this right way..

        they arrest the bagel boy and anyone else to have a face to this matter.

        And if you read all the articles, you have people saying how the area always smells…THERE IS A SHIT FACTORY TWO CITY BLOCKS LONG. That has smelled since the beginning of time.

          There’s a different smell to the processing of sewage water vs. the raw sewage itself. There’s also the visual evidence of the dye and the toliet paper for crying out loud. Saying they spent $2M is supposed to convince me of what? They can produce evidence that they’ve tried to fix. Besides, what does it cost to do the job right since you have the stats and the facts?

    obsviously this is also a health hazard, so then why weren’t these places closed or issued vacate orders. If memory serves me right, our former Mayor Rudy use to have places likes massage parlors and bars padlocked after arrests were made based the arrests, building code and health code violations, thus forcing landlords into court to show themselves and answer

      because when facts get out, you will see how blown out of proportion this is. You are seeing a one sided argument right now. Just like big bed bug scare at the theater. One auditorium had it and was taken care overnight. The seats were pulled out and never had a problem again.
      It was treated as if bed bugs started running the movies.

      You will see that the company paid for repairs throughout the years. And when they realized what was happening wasn’t working, they put $2 million into a new piping system. No one has seen any numbers of whats polluted. All you heard was toliet paper and green dye. And then you get this green picture rendering that looks like all of Brooklyn was covered in ooze.

      Just hold judgement till you see facts. Remember these are places that hooked up your kids with jobs in Gerritsen. I have a bunch of friends that work at Fridays and the movies that all come from your area. Just iwait guys before you go on witch hunts.

    All of you on here are idiots, you guys have kno idea what’s going on. That water has been disgusting for years not because of what’s going on here , but because you have all these little kids going down the creek and throwing shit in there ,doing drugs and polluting the environment .Maybe you should go all the way down into the beach and check out the point see how much garbage and used needles are over there .maybe all you concerned people should first keep your own neighborhood clean and control your kids, before jumping to conclusions about the business owners .. All you do is read what in the paper and believe what’s on the news and what the media has to say .. I bet each and everyone of you are going to be eating at fridays, buying things from the deli , and then going to see a movie !

      You have to be kidding, you are trying to equate someone littering with the systematic dumping of raw waste into the creek. The only thing your post illustrates is your disdain for the surrounding area and your inability to mask that disdain. Anyone with the least amount of reason and analytical skills can distinguish between some individuals littering and the issue being addressed by this story. On a related note, the trash being thrown into the creek is troubling, I assume it has nothing to do with drugs, but that was just another lame attempt to slander those from the area. I do know that a great deal of the mess at the point is left there by people from outside the beach. I know this because I frequent the area and have seen people order food and leave the refuse behind. I can only assume some is from those in the area too. Either way the actions of those involved in leaving their trash on the point is deplorable but it pales in comparison to dumping what one has to assume is millions of gallons of feces into our water ways.

      Stop trying to mask your attacks on the areas around the creek with half assed logic your motivations are extremely transparent and dont add to much to the discourse at hand.

    If there was in fact willful neglect in this case then by all means let the legal process play out to it’s conclusion. Although I for one want to know why it is then OK for DEP to dump raw sewage into the water every time we have a heavy rain storm without the threat of arrest? This after the city has spent untold millions of dollars over the last 30yrs to improve the sewer treatment plant. Seems like a double standard to me.

    Kanpp St Deli is a tenant only! This is the Landlord’s responsibility! The Knapp Street Deli notified the LL immediately upon receiving the leak violations. The Landlord, Nakash Bros Realty is the responsible party and liable here! I don’t know about the other businesses, although Nakash owns most of the property around there!

    Are we stupid or what? Why aren’t these places of business shut down until they fix the problem? They can continue as is and just pay a fine? It may be cheaper to pay a fine then to correct the problem. SHUT THEM DOWN! SHUT THEM DOWN UNTIL THEY FIX THE PROBLEM.

      Devil’s advocate: Even if they could be closed, politicians are going to call the agencies asking them to allow the business to remain open while negotiating the terms of the violation, since closing it will effect employees, local economy, etc. And most cases end up involving fines and restitution, don’t they?

    Paul, I couldn’t agree more! They never should have been allowed to open up in the first place without proper facilities. How did these establishments pass all the inspections by buildings dept. to get permission to open? They had to have known from the start that the septic system wouldn’t handle the amount of people that would be going to the restaurant and movies. Does anyone know the year that they opened? They know it’s leaking/spilling since 2003, but when did it actually start? I’m with you, CLOSE THEM UP NOW!!!!!!!

    I am retired now. This “sick and tired” feeling of being jerked over by businesses and politicians has reached a point where it’s time to do something about it. I hope to have the continuing motivation to develop the website I have been spending time gathering data for. But anyway, I am going to start HERE, and do whatever I can to organize a front against these people who have no regard for the health of the people in the “beach”. I need to gather more info on this (this is the first site I visited concerning this), and then I am going into action.     If the sewage was leaking in other areas of the city there would be protests and the businesses would have been closed by the health dept….We just don’t make enough noise and whine to the right people we have to learn the only way to get anything done in this city is to become a big pain in the butt to politicians and stop praising every little bit of c–p they give us… we couldn’t even get a traffic light or a promised stop sign and avenue V has one on each corner on the other side of knapp street just take a look next time you drive over there, there isn’t even a school at those corners why is this???
