    That's nothing new. Back when I was a teen, growing up in the Beach, the cops would randomly stop and interrogate us just walking along minding our own business. Perhaps having long hair at the time, we were always under the suspicion of carrying contraband.

      Use common sense if you ask " am I under arrest" and the cop says no I just want to ask yoou a few questions then you are ok …unless you really have done something. If you are guilty then yes ask for an attorney

    Its funny that on this blog everyone complains how deplorable the kids in the beach are: wrecking the playground, destroying the bus shelters etc… and now some one is trying to actually do something about it and we arm the kids with the means to get out of it. Im no Lew Fidler fan, he's probably just doing this to protect Seba Park "his project". Im sure he will wear this on his sleeve in some future campaign. But what he is doing is a potential solution to all the "not my kid" problems we have. If the kids have nothing to hide thay should have no problem answering the questions. I wouldnt.

      Hold on one second. It's one thing to patrol the parks and "interrogate" kids and teens and other individuals who are in areas of vandalism after hours. It's another thing altogether to stop random people on the street. If they arent entering a sensetive area, if nobody has complained about loitering, then they shouldn't be bothered.

I dont think this is a "Big Brother" excersise here, we have been complaining for months, or is it years? that there is no police presence in the beach. Now that there may be we are up in arms?           Please. It's never really random, and it shouldn't be. That's the point. "Random" citizens who aren't causing any trouble shouldn't be "randomly" stopped. It's not like they are entering a train station or a school or some other sensitive place.

          In our quest for law and order and justice we have to be very careful about what lines we cross and I feel that's one of them. Especially when they start recording specific details about people like their weight and tattoos. That's a violation of the 4th Amendment.

          Police are required to have probable cause to search someone, period. If a neighbor calls and complains that hooligans are hanging around near their home then that's permissible. If they are in the park after dusk. If they are being unusually loud (I think 15 or 30 decibels but i'm not sure) then that qualifies too.

          There are plenty of legit reasons to question someone and ask them for ID, but documenting their personal details is crossing the line unless they are being arrested with an actual crime.

          The Cops can't go from one extreme (ignoring the problem) to the other (treating everyone like a suspect). They need to actually do their fucking jobs and, I don't know, INVESTIGATE.

          Casting wide nets is lazy work.

            Wow Arthur B, settle down now! If you actually read my post I agree with you!!! They SHOULD NOT BE STOPPING KIDS RANDOMLY! But if they are in an area where vandalism has occurred (as we all complain about daily) and they fit the profile, I have no problem with them being stopped, I didnt say arrested, but stopped and asked "Hey what are you up to". Especially if they are just "standing around" or "hanging out". Loitering is illegal and the police have the right to ask.

    @ Huh? Your so right! I don't understand why this is such a big deal…the police are doing nothing wrong and are attempting to help identify the people who are vandalizing our community. This could help with figuring out whether these kids are from our neighborhood or another and who they are. Let the police do their jobs (something we claim they never do)!!

      Violating rights to bump up arrest records is not doing their jobs. NOONE IN THE 61 cares about anyone in this neighborhood. Their plan is to reign us in for those who really want to move in down here. Take a look at Marine Park. As soon the people who are moving in there in droves feel that this neighborhood is made safe enough for them they will invade here too. The police will do whatever those peole want them to do.

    Are you shittin me !!!! One day its the police aren't doing anything the next its why are the police here in the beach.

    Let's start with the posting, if the police are stopping people and asking questions like their name, address, and so on that is not an interrogation. They are asking simple common questions of inquiry, that is an interrogation, if they were asking where someone was at a particular time because of a criminal event or if they blamed them for something, then yes they are interrogating someone and yes they have a right under the 5th amendment not to answer questions about the event, just as the legal eagle in the video says, but did you notice that the legal eagles in the videos never said anything about being asked your name and address. The videos only address if you were being asked questions regarding a specfic criminal event, not any questions about common right of inquiry

    People you really need to wake up and decide what the hell you want and expect. One minute your crying that things are being damaged, set on fire, stolen and are demanding police action. Some are calling sit down meetings with politicans and police officals. Then you're crying that a politican wants kids arrested for causing THOUSANDS of dollars in damage and some offer up stupid questions like what time is dusk, so they can warn the lovelies as to what time they can be in the park and you bitch that some might be arrested or issued summons.

    Now the police are letting it be known that they are in the area by stopping an asking common inquiry questions, which to me is a wake up call to those who have been lets say a little naughty and not playing well with others. So what does someone do they start crying that the police are stopping people (probably teens), asking their names and where they live, picking on their poor innocent teenager, get over it thats their job and you and everyone else down here has been crying for months for the police to do something. Maybe instead of posting useless videos that some not so smart kid may take to far and push a cop a little to far which could then really put the youngster in trouble when the cop shows him who and what the police can do and a give him a temporary cot for a night or two with some new roommates I mean cellmates before seeing a ten dollar a hour legal aide lawyer who tells him the police can inquire as to his name and he should just go before the judge, be polite, apologize and plead GUILITY.

    Wake up people, you wrote about it and complainned, you bitch to authorities and now when the police make a small showing you cry, get over it, live with it and be thankful the police didn't send an army down here and stop everything every age moving and do a letter of the law enforcement

    To those of you who think theres nothing wrong with the police stopping people on the street, consider this. COPS LIE ! They will arrest anyone for nothing just to make an arrest & you can go tell your story to a judge. Case in point : the so-called race attack on bike theives of a few years back when the police swept the neighborhood picking up innocent kids, some of who was'nt in N.Y. at the time of the incident. They also harrased residents in hopes of someone dropping a name. Years ago in my teens the police grabbed me walking home because a store window had been broken. If it was'nt for an older gentleman coming forward to tell the cops it was'nt me I would've been on my way to central booking. If you think they won't arrest a kid for nothing, think again.

    When did this "Not my kid" mentality start. There is more bitching and complaining going on now then ever. People complain "Those rotten kids break the bus shelters and destroy the parks and nothing is done" Now cops are letting the kids know they are in the area and meeting them face to face, asking simple questions like name and address. I can understand it the kid doesn't want to give his address, I tell my son not to, but what is the problem with the name, why does it have to be looked at as an interegation. Might just be the police dept trying to rectify the mistakes they have made in the past (shitty starting pay that caused the hiring of less than qualified individuals) and going back to a time when you knew the cops that patrolled the area and respected them. Like every orginazations and groups there are bad seeds that need to be removed. Lets see what becomes of this first, before it is condemmed.

    I was brought up to respect my elders and those in a position of authority (teachers, other parents, cops) the younger should always show respect first it starts as simple as "Yes or no, maam, sir, officer, etc."

I for one have raised my children to always be respectful & cooperative if they ever have an exchange with the police. It's only when you fail to stop and answer questions from the police, try to resist them, run them over with your vehicle, or reach into your pocket when told to be still that individuals end up in a bad situation.     It is amazing with the people in this neighborhood. You complain about the kids then when the police do something about it you complain! Lets get real here, there are alot of BRATS in the neighborhood who cause tons of trouble and vandalize there own neighborhood while there parents choose to look away and not do a friggin thing about it. Plenty of times I had to chase loud disrespectiful kids away from the front of my house late at night when people are trying to sleep! Why dont they just stay in front of there own houses? Well, there parents would not like I that! I have witnessed with my own eyes how bad and destructive these kids can be so I say let the cops do there job! Nice that you are complaining and wanting your kids to have disrespect for law enforcement! I am tired of all of this and I applaud the Police! Keep these spoiled brats in line!!

        I called them once and politely asked for help with a non emergancey situation. I called 311 and was directed through that system to the desk Seargent. I got an attitude and was talked down to and more importantly they refused to help me with the issue. The 61st Pct is absulutely useless and wants nothing more than to pick and choose what crimes they handle to fit their political agenda. If you think it is strictly an issue of the police responding to how the complaint comes at them you need to get the pixie dust out of your eyes.

    In the old days (!) Tom Fox, the cop on the beat in Gerritsen, used to take kids home to their parents and tell them what the kid did. That worked for a while. I think it was sometime in the 60's that the parents started saying "I'm sure my child would not do that". He stopped taking them home. Too bad. It's a different world.

    Just a thought but maybe the 61st is trying to improve their "stop & frisk" stats by targeting mostly white GB kids to balance off their stops of minority kids in other neighborhoods. I'm not looking to start a big race discussion here but I never heard of random stops of kids in historically low crime areas.

      Its not low crime, maybe low violent crime, but just browse this blog youl find:

      – Destruction of Seba park including:

      – Lighting the Skate Park on fire

      – Removing the benches and trees

      – Graffiti

      – Broken bottles

      – Hanging out in Parks past dusk and into the later part of the evening

      – Destroying Bus Shelters

      – Riding Quads in the neighborhood streets

      – The yearly Halloween debacle

      Im sure there are many more. The neighborhoods that have a higher concentration of minority residents have there own problems. Gerritsen Beach has its problems. We all pay taxes, maybe someone is finally going to improve the quality of life, Maybe not. As long as its done within the parameters of the law I cant see why anyone would be against it.

    I repeat, “I don’t care what the naysayers write from behind the shield of anonymity. When there is a problem, you do the best you can to solve it. How many of you can remember how bad graffiti was at one time, with every subway car scribbled from top to bottom and throughout. There were people who believed it could be changed. Was it eliminated? No, but it is a trickle today, by comparison. Of course it requires legal enforcement, as does the vandalism anywhere and everywhere. Our Councilman responded to the requests of people from this community when the section that is now Seba Avenue Park had become a dump. He has expended a lot of time and energy into acquiring money to build the park, and he is right, that those who are responsible for illegal acts should be dealt with “legally”. The other day, a young man was stopped by the NYPD and asked where he was coming from on Gerritsen Avenue. He wisely answered every question that was asked of him, and was sent on his way. Some of the wags have already said “they can’t do that”. “They” can do that, so I’m going to cite the instructions from–of all organizations, the ACLU–”What to do if you’re stopped by the police”–in a separate slot. In the meantime, we are proceeding with plans to develop programs to “enlighten” our youth.

      Let me tell you why people in this neighborhood stay behind the shield of anonymity. Several years ago late one night a gaggle of teenagers were hanging out on the street. They were being extremely noisy. One of my neighbors called the police. I do not know which neighbor made the phone call. As far as I know, no one knew. The police came. I do not know the exact details of what transpired between the police and the teenagers but some of them were hauled off to the station. Evidently the parents of one of the girls arrested had a major hissy fit that their little darling innocent daughter had been arrested.

      I do not remember exactly when this next little thing occurred but the next night or the night after that every car within a one block radius of where "the little darling" had been arrested had a window broken. They were going to make sure they got even with the person who did this to their baby.

      Imagine what would have happened if "the little darlings" family knew who made the phone call.

      I will stick with my shield of anonymity thank you very much.

    1. It’s not a crime to refuse to answer questions, but refusing to answer might make the police suspicious about you. If you are asked to identify yourself; you should give your name and address and identifying characteristics, if that is what is asked for (e.g. height, weight). They may be looking for someone who matches your description. Don’t get in an argument with the police. Remember, anything you say can be used against you. Keep your hands where police can see them. Don’t run, don’t touch any police officer. Don’t resist, even if you are innocent. Don’t complain on the scene or tell police they’re wrong or that you are going to file a complaint.       If your not doing anything wrong, you have nothing to hide. Better yet, if your not doing anything wrong, why should you be stopped ? I guarentee, next time some genius does something stupid in the park like starting a fire, the police will grab any kid that makes it convieneant for them whether they did it or not. Heres an idea, patrol the park on a regular basis, then arrest anyone you see breaking any laws. Don't create annomosity by stopping people that don't deserve it.

        The point is if you did nothing wrong and are stopped by the police you have nothing to fear. If someone fits the description of a criminal, or if the police have cause to suspect you, if they dont stop you and ask you questions how would they know?? If you are innocent and run when the police approach you that makes you look guilty, even if youre not.     I don't know where you got your info from but, in the 20 years i was with the NYPD, I never saw an officer lie (to make his case, or get an arrest) there are plenty of people doing bad that you

      I've worked my whole life too. I'm an honest person, but that did'nt stop me getting arrested twice for no reason. Both times dismissed because their was nothing to support the charges.You are a good man, no doubt. But please don't try to tell me in 20 years on the job you never heard of any wrong doing. If a cop screws up other cops will lie to protect him/her. Police have been caught in the past fabricating charges to boost arrest records for promotion purposes. Police are just like anybody else in any walk of life, somegood/some bad. Also people lie in court everyday, just read the papers. Where did the term "throw away peice" come from?         Having a bad day Just Wondering ??? How did this post turn into the Police being the perpetrators of the promblems in GB. Hey like any profession there are a few bad ones and sorry to say, if you remember back a few years the standards of hiring are very low and more recently the standards have been basically eliminated, with that said the men and women doing their job are more in the majority and I'm sure just don't go to work thinking how they're going to lie and ruin someone's day or life.

        The fact remains, there are problems mostly minor in GB and GB went to the politicans and the Police, now since the calls haven't ended for something to be done, a little pressure is being applied, live with it get over it, they're doing the job GB called them to do.     Not having a bad day,just being realistic. If you read my past comments you will see that i don't condone the destruction of our parks & i would like nothing better than to see who's been doing it to be caught. I've also said not all cops are bad. The point I was trying to make is get a cop having a bad day & combine that with a innocent but smart mouth kid being stopped on the street. It could turn into a bad situation that was not there to begin with & it would do nothing to eliminate the situation in the park. Once again, case in point: so-called race attacks of a few summers ago. Police picked up kids for doing nothing more than walking down the streets . If you were a parent of one of those kids, would that be enough for you to have a bad day? How much trust would that instill in you of the police? Theres 2 sides to every story.

      Stop please. The police didn't just stop "kids" for being on the street and arrest them. If you're partially right in that the police did arrest "kids" on the street they needed something called probable cause to make an arrest and hold them. maybe those "kids" walking on the street were breaking a law or maybe these "kids" weren't minors. And you're right if I was the parent of a minor arrested I certainly would have a bad and so would my kid if I found out they were caught by the police doing something illegal whether it was drinking in public, possession or a burglary

      News flash for the parents of GB – drinking in public, drinking under the age of 21, smoking weed, being loud in public are all against the law in this State oh yeah and don't forget the bicycle on the sidewalk

        Just wondering- I agree with all your posts. I don't understand why people can't see the potential for disaster here. And I don't understand why people are so against the above videos clueing people, especially kids, to their civil rights. Not that I don't think the ACLU sometimes goes to the extreme with some of the cases that they take on, but that is what keeps our rights as citizens intact. What is really wrong with a group, the ACLU, that fights to protect the Bill of Rights? After reading some of the opinions that people have here, I am very happy that they are there, or I would fear us sliding down the slippery slope into Facism. It's amazing that some people don't think our rights as Americans should not be extended to our children, our teenagers. I became involved in this discussion because I thought it was appalling that Lew Fidler pretty much said, arrest any kids and get them to give up the real perpetraters. Let the cops solve crimes, not intimidate kids.

          Thank you, I'm 52 & lived in bklyn my whole life. When i was young there was alot of nice cops i was friends with. I also encountered alot of pricks that would slap you around because they felt like it. And yes, they would grab anybody to make an easy collar. I don't know what perfect place some of these people lived & worked in?

    If no one knows who does the vandalism in the park, then why is it only kids that are being targeted ? More than likely the benches were moved by kids, but maybe the fire was set by someone who does not want a skate park in their neighborhood & the kids it attracts from other areas. Are all adults going to be stopped by the police too ? That would seem only fair.

    Has anyone considered the fact that the kids they are interrogating/harassing on the streets are minors; the police officers do not have the right to interrogate any children without parental supervision or proper representation? What happens when a kid refuses to answer any questions? This is within their rights.

    Say the kids are walking home from school, the store, or playing in the ball fields and there were no issues in the area at the time of the interrogation. They (the police) do not have the right to stop them or ask anything whether it be name, address, age, height, or weight without first contacting their parents or guardians for permission to do so. If they (the police) have a warrant issued with a description of a suspect and the kid they stop matches that description, then they will have the right to ask questions at that time like name, address, and age and or arrest the kid/s if they fit that description.

    Even at that point, they still do not have the right to interrogate without a parent/guardian or lawyer present. Are the police going to read the children their rights as citizens of a free country? Do the children have the wherewithal to understand what they are being asked and why? Don’t get me wrong, I do understand that something must be done to stop the unnecessary vandalism of our parks, but it has to be done within the law and not above it. Like you and I, our kids have rights to.

      Jim, they don't even know if it's kids that are doing it because they don't know who's doing it. But lets target the kids & intimidate them with no cause. If everybody is so sure of who's doing the damage to the park, then name some names. Otherwise don't target every kid in the area.

        If a park was vandalized in another area, say Boro Park for example. Would the police go stopping and questioning all Hasidic teens in that neighborhood? I don't think so because Dov Hikind would have 1000 hasids in front of Fort Surrender demanding that it be stopped. That's what happens when you have a representative who has the balls to stick up for his constituants. Us in this area don't have that.Instead we have a Councilman with a man-gina.

      Hey Jim, I'm sure your intentions are all well meaning but you are way off on your info and whoever gave you the so called legal advise needs to go back to Criminal Law 101. Asking someone, that means ANYONE, pedigree information is not an interrogation, hence a minor, which in NY State depending on which law or statue you are applying may vary anywhere between 16 and 19. The easiest proof and example that minors must answer questions of inquiry is that teenager who drives and is pulled over, the teenager can NOT call mommy before producing their license nor are they given their wonderful miranda rights before they are asked and required to answer inquiry questions, like whose car they're driving, etc

      Now here's a free law lesson, an interrogation only occurs when someone is in POLICE CUSTODY. Check with whoever or whereever you want on criminal law and you'll see if Johnny isn't in custody then Johnny wasn't interrogated he may have been asked simple questions (common right of inquiry) but not interrogated. As you know I'm sure if someone were interrogated and were not given their American right to the miranda warnings then whatever they say can not be used against them and the second greatest American right that you can NOT self incriminate yourself, the law needs other evidence / proof besides your mouth.

      Next, in NY State a Police Officer, as defined in the NY State CPL, do not need warrants to question or arrest people, so you were given bad information again, (key word Police not Peace or Special) The Police would NOT be given a warrant to search for or question someone. Judges sign warrants based on probable cause and evidence for a particualr reason not on guesses or hunches. i could see it now every crime in Brooklyn with a basic description, a cop running for a Judge to sign a warrant so they can do a search and investigate the crime, lmao rotfl.

      Fact, yes any minor in police custody can NOT be questioned or interrogated without a parent or responsible adult present, ie teacher, clergy, lawyer. relative, it is NOT an absolute legal right that it must be a parent, remember somethings the parents can be the bad guys

      Hint, find out what custody and interrogation mean in the criminal world not the real estate or civil or backyard world

      like I said I'm sure intentions are well being but giving out bad advise to people who might thing hey Jim says I don't have to do something could be very misguiding and costly to an innocent mind or their "not my child" parent.

      WRONG !!!! Jim you really should get updated NY State Criminal Law information before you start saying things that some people may think is right and be misguided. No warrant is ever need for the police to talk, interview or interrogate anyone. infact if a police Officer had an ARREST Warrant for a paricual named person they can not interrogate that person but they can interview them for basic pedigree information. Second no authority needs permission from any parent to talk to a minor, they do an adult present when interrogating a minor but not interviewing or asking simple pedrigree questions. Please for the benefit of the young and naive who might think your information is best for them stop giving legal advise. this is not civil where someone might lose some money it maybe criminal and someone may lose some time being free

    Just to set the record straight……If you re=read my post, I just said "I" personally never witnessed a P.O. lying to get an arrest….no doubt it's been done, but as I said before there are plenty of people doing bad that you don't have to invent anything Sure there are some bad cops, (and some dirty ones)

    but basically, if you aren't doing wrong…don't worry, they got their hands full of the people that are……i

      the cops in the 61 are garbage..especially the detectives..you have to see this circus and all those clowns in action personally to believe your own eyes..i can fully understand why people have no respect for them,they bring that attitude towards them upon themselves..go to hell 61!i would hate to rely on you in a real crisis

    I was under the impression the police could stop you if they had probable cause to think that you committed a crime, or are carrying a concealed weapon… not just randomly stop people for no reason. If a crime has been committed than by all means stop and ask questions but if kids are just walking someplace and behaving themselves, than just leave them alone.I do not believe police want to stop people just to harass them, and it is not fun making an arrest especially having to sit in central booking for hours , believe me.

    Intresting story in todays NEWS. A police officer & PBA rep blew the whistle on a Captain for making cops write summonses for things they did'nt witness & for fabricating charges against civilians. Now he's being called a rat. But not to worry, they promise not to fabricate charges against any of theBeach kids because there special.Keep living in TV land to all who think theres nothing wrong with your kid being stopped without cause.
