How can we have any other view on this? Otherwise, those with the bucks can do whatever they want, and the rest who don't have the deep pockets can not? Is that right? Why have any zoning at all? Lundy's, back in it's hey day had 2,800 legal seating. Now maybe a few hundred or so. The seating numbers quoted are impossible based on the seating configuration and floor space, etc. A successful restaurant can easily operate there, if, you have the right operator who knows how to manage a restaurant, with good food and good service, both! The three prior operators from Dec 1995-2007, tried, but didn't have that restaurant touch. It is not an easy business and 90% fail, BUT when run well, it can be a fabulous place and a great draw and thus becomes a destination for the entire area. There are some very successful seafood houses and seafood operators with class and great food worthy of the landmark Lundy building; but it's too bad most of you haven't seen the bigger long range picture here, nor have you understood the sub-landlord's dealings and not even wanting to talk with many of us in the legal restaurant community about making this actually happen. There are several legal gourmet markets just north on Avenue Z where the legal zoning calls for that kind of community service businesses. One of those markets even gave "Mr. Cherry Hill" his start in Bath Beach. I will end this utter waste of my time, since I stumbled on this site by accident doing a internet search and merely clicked by sheer error, and read the posts and thought I might give you something to think about. The Special District for the most part is working, the residential option is essentially in there. There is no mention anywhere in the zoning of a "fishing village". That was hatched by the community groups nobly trying to make the "village like" tourist small scale attraction with thousands of parking spaces come to life. I know all this because I was involved in a few real estate deals down there at the time. The idea of certain uses on the bay in the larger long range view does have some credence, but no one here is addressing real planning and what zoning, especially Special Use Zoning is designed for. The Belsky comments about resurrecting the fishing fleet are plagued with ignorance on the subject and kind of funny. The parking is lost for the fleet, regulation has crushed them, there are essentially one bait & tackle left(down from 8!) the city has leased pier space to dinner boats, instead of marketing to party fishing boats, the marine supply stores are gone, as are the local ship yards for their repairs, access to the piers for the last fishing operators is curtailed, fuel has been the icing on the cake and we went from maybe 40 or so fishing boats in the late 70's early 80's to about 6! The boats are scattered up and down the East coast. I know, some of my family was in the business too. Since I do not intend to come back to this site, you should all step back and ask yourself honestly, if the law should be followed by all or applied differently to those that spend a lot and make it look nice? If, yes, then so long as someone makes it look "nice" and spends a lot that's ok? A dangerous precedent here. Then, I could build whatever I want, anywhere I want, so long as I too make it nice and spend a lot, right? The betterment of the whole community is not for this one guy, no matter what it seems on the emotioanl surface, but a real step back for following the law across the community with string strict enforcement for all. In the long term, the most restrictive zoning, the tougher community's that do not cave in to money and it looks nice, are the most desireable at the end of the day! Just like the comments from those in GB that don't want their area to be overbuilt like the Bay> Save and preserve what is left! Would the Heights, Park Slope, Ditmas Park or any other historic or Ocean Parkway's Special District allow a market where the zoning strictly said no, even if some wanted another market closer to their house? Sorry Cherry Hill, the importance of the entire community and the over 200,000 residents of Sheepshead Bay are bigger than that and to stand for enforcement and taking a stand is always now, today! Where were many of you during the Loehmann's battle, the Lundy Landmark fight? Draw the line, fight now or you will be run over by this bad precedent. The entire community and it's very special unique waterfront outweighs one market, even a million dollar market! The law as it is written now must be respected and followed, here and everywhere. I actually know someone that was hired by Cherry Hill, but is unable to start work because of the three amigos. This person is a single mom who is depending on this job to survive. Maybe Mr. Krugar, Mr. Nelson or Ms. Scavo could hire her, since they are the reason why she can not start work. Thanks guys, you've got my support.
