Lundys: Cherry Hill Mystery Stop Work Order – Must Vacate

Lundys which was set to open next week has just been hit with another stop work order.

It looks like a “fix” may be in with Cherry Hill, as Steve Barrison, leader of the Bay Improvement Group, sent an email out on April 8 stating “the DOB came down today and issued violations and a stop work order for the violations of the Sheepshead Bay Special District USE zoning which forbids MARKETS!” (via SheepsheadBites.com)

This information is contrary to inquiries made to the Department of Buildings, who claim that the sign off of the plans has been revoked, for work contrary to plan, and for occupancy contrary to zoning. This is all a fancy way of saying that Cherry Hill violates the Sheepshead Bay Special Zoning. The department of buildings stated that the violations are effective TODAY APRIL 9, not April 8.

Does that mean that Mr. Barrison is in on trying to squash a business that invested millions into Sheepshead Bay?

Also, the Department of Buildings noted that a DEPUTY COMMISSIONER inspected Cherry Hill’s work on site, not a DOB inspector. Since when does a commissioner inspect buildings, wouldn’t that be like the police commissioner pulling someone over for speeding?

Update: Cherry Hill is being told to vacate the building by DOB, by tomorrow.
Questions people need to ask!
How does the city go back and negate plans they already approved?
Where is the commissioner that approved those plans in the first place?
What is so terrible about what Cherry Hill did?

    This truly is unfortunate – not that the building was violated – but in the manner in which people in this community have acted to get their way.

    We can argue about the merits of the existing zoning and its interpretation from now until the cows come home, but, sorry to say, that’s not the issue here anymore. This has turned from an examination of the Special District’s limits and interpretations into a dirty political game.

    The people are once again victims because the rules of this dirty political game seem to apply differently depending on who you are and who you know.

    This is a game that we want nothing to do with at all. SB/PBCA has and will continue to operate openly and honestly for all to see. We will act as we always have – watching and listening learning about what happens from here with this treasured building.

    This really is really horrible what has become of this. If I were the one making all the changes etc to this building I would imagine that it is almost time to walk away and watch it all rot away as it was well on its way before they came along.

    The place looks great an hopefully it will be resolved soon.

    Business gets stop-work order for violating rules

    Senator Carl Kruger (D-Brooklyn), Chair of the Finance Committee, today praised the city’s Department of Buildings (DOB) for issuing a stop-work order against the Cherry Hill Market, the business currently under construction at the former site of the famed Lundy’s restaurant in Sheepshead Bay.

    In addition to the stop-work order, the DOB slapped Cherry Hill with a violation for “occupancy contrary to plans,” effectively confirming what Sen. Kruger has long been saying – that Cherry Hill was not opening as a restaurant, as was indicated on its application, but a retail market.

    This use is not permitted according to the parameters of the Special Sheepshead Bay District, the special zoning designation awarded to the historic area following a lengthy push by Senator Kruger and other community leaders.

    “Once you decide that the special district is a slippery slope instead of a zoning regulation put in place to protect the community, its integrity is gone and soon you’re left with nothing to protect,” said Sen. Kruger.

    The location occupied by Cherry Hill at 1901 Emmons Avenue is the former home of Lundy’s, the world-famous seafood restaurant and an official city landmark. When Cherry Hill first began work at the site several months ago, Sen. Kruger spoke out publicly against the “destruction” of the building’s awnings, sidewalks and other accoutrements and brought his complaints to DOB, City Planning and the Landmarks Preservation Commission. Questions about the zoning laws followed and the developer eventually re-filed his plans – prompting today’s stop-work order and violation.

    Sen. Kruger said that “enough is enough.”

    “The individuals who have sought to develop this site has been given ample opportunity – more than ample, in fact – to demonstrate that they capable of being good neighbors. The only thing the developer has succeeded at, unfortunately, is continuing his pattern of deception and underhanded behavior, and thumbing his nose at the community,” said Sen. Kruger.

    “We want businesses that will enhance the Sheepshead Bay waterfront district – not undermine it,” said City Councilman Mike Nelson.

    “Making sure that Sheepshead Bay is preserved for our children and grandchildren remains our priority,” said Theresa Scavo, Chair of Community Board 15.

    Gang warfare at its finest. They each lie and then they each swear by it. Typical politics down here.

    Carl is no more a preservationist than Joe Sitt or Forest City Ratner! For him to write about preservation? Geezalou! Where have you been Carl? Do you see Emmons Avenue? What about all the other violators? Or are they OK because they made sizeable contributions to your campaign. How the hell do you have a press release go out before the violations are served?!?
    It stinks worse than rotting fish.

    Of Course Scavo’s gonna go along with it, after all, she got the boot thanks to Lundy’s, so anyway she can put a hurt on whoever’s there, she’s all set to go! Especially after being embarassed that her 50+ phone calls to DOB were all unfounded and that they stopped picking up the phone for her.

    Mike Nelson is hardly worth a mention, you might as well call him Kruger Jr.

    I hope this business sues the crap out of all of them for harassment and finds enough dirt to bring them all down.

    Having a large commercial space with great potential sit empty and fall apart is not preservation. So is not being on top of DEP due to the deplorable conditions of the Bay with tons of trash and dead fish floating and decomposing in the water. I know who is NOT getting my vote.

      Especially when you’re getting the best of both worlds – a business in the largest and most central commercial space on the Bay that wants to invest in the area and create jobs while being required to preserve a landmark.

      They should have worried about preserving Sheepshead Bay before they allowed all those awful condos to be built. Now, I wonder how that happened. Lundy’s is not LUNDY’S, so let it go and lets get on with progress. We need markets to shop, clerks need jobs, etc. Sheepshead Bay is already ruined, the old Sheepshead Bay is gone for good. It is no small quaint fishing wharf, it is a dump.

    From the pictures I’ve seen on this site, it looks like a beautiful building inside. Why did they wait so long, and allow all that money to be invested , and then put through a Stop Work order? All those empty condos and co-ops along Emmons Avenue aren’t going to preserve Sheepshead Bay. They are slowly going to decay with noone buying them or living in them. And the fishing fleet is slowly being decimated for many reasons. And so it just goes on and on. As Anonymous said, Lundys is not Lundys anymore. And it never will be again. That time has come and gone. So let’s get on with it.

    Sheepshead Bay, oh what memories.
    In the 80s when it was starting to show its age, this city rose to the occasion and announce the revitalization of all of Sheepshead Bay. I remember seeing illustrations of pedestrian malls, unique boutique shops, restaurants and coffee shops. Where else in Brooklyn could you find the unique atmosphere Sheepshead Bay had to offer. So the city pursued diligently to makes Sheepshead Bay a shining star of what can be accomplished, when the cooperation of community leaders, politicians and local business owners got together.
    Then the reality sets in. First to occupy one of the prize parcels of land was a insurance company. Followed by a 3 story retail department store all but eliminating the hopes of small upstart retail businesses in the area. After that display of mismanagement, they felt that six-story apartment houses and multi-condo structures would also fit in very well.
    Why have restaurants and coffee shops when we can have a Dunkin’ Donuts.
    The pedestrian mall??? No, let’s have parking meters instead.
    And one wonders why there are so many discontent citizens in our community today.

    When things settle down and the paranoia wanes, the “plot” will look more like a simple desire to have Sheepshead Bay like a bay — with fish, boats, people, visitors, fishing, food, dining, views, fresh air. Oh, and yes, shopping, hopefully at markets of all kinds. Something like what so many bays and waterside places all over the world have — all nautical and inviting.
