Frank Solivan Family Sues Patrick Donovan

The family of Frank Solivan is suing Patrick Donovan in Kings Civil Supreme court over the accident that killed Frank Solivan on May 24th. Patrick was the other vehicle involved in the accident.

The trial begins 01/09/2009 and here is some more details.

Last year, The Solivan family was sued for negligence and wrongful-death, after Frank Solivan allegedly punched out Antonios “Tony” Fasarakis, killing him. Solivan initially was charged with misdemeanor assault, but the case against him was dismissed in December after Queens prosecutors declined to pursue the case.

NY State 8th Worst in Water Quality. Kiddie Beach 2nd Worst in City.

The water quality at New York State’s beaches is getting worse, according to a report by the Natural Resources Defense Council. The number of water samples taken at coastal and Great Lakes beaches that exceeded state standards for bacteria reached 11 percent in 2007, up from 9 percent in 2006. New York ranks eighth worse (out of 30 coastal states ) in terms of the percent of water samples taken at beaches that exceeded health standards. And it seems New York may have snagged the council’s prize for least forthcoming state.

On that measure, at least, the city does better by providing lots of data. And the environmental group’s report applauded the city’s monitoring of its beaches and its method of issuing advisories. But in describing the city’s pollution of its water, the report paints a sickening picture (particularly if you’ve been at the beach recently) of a witch’s brew of stormwater and sewage flowing into the sound and the ocean.

Despite that, the city’s beaches are cleaner than some of those on Long Island or along the Great Lakes.

As in previous years, the private Douglas Manor Beach was the city’s dirtiest by the report’s measure, with 20 percent of its samples exceeding standards. It was followed by Gerritsen/Kiddie where 14 percent of the sample did not meet health standards.

No city beaches ranked among New York’s worst. Fully 44 percent of the samples taken at the foulest beach — Suffolk’s County’s Tanner Park — exceeded state standards for bacteria. Next was Wright Park West in Chautauqua at 38 percent, Ontario Beach in Monroe (37 percent), Venetian Shores in Suffolk (33 percent), and Hamburg Bathing Beach and Woodlawn Beach-Woodlawn Beach State Park in Erie (both at 31 percent).

Kiddie/Gerritsen: threshold levels of 0.2 inch per 2 hours or 0.4 inch per 24 hours (advisory duration is 72 hours).

DETAILS: The run will start at FBF. It will proceed over the Marine Park Bridge(pay toll). It will than proceed down Beach Channel Drive, to the Cross Bay Bridge(pay toll). From the bridge,to the Belt pkwy(west). Exit at Knapp st(exit 9). After the Belt the run will end at Tamaqua Bar.

There will be 50/50 raffles. Bar does have food and full stocked bar(not included in donation).There is a parking lot. Indoor and outdoor seating area, pool table, etc…

The feisty founder of electronics behemoth The Wiz is threatening to sue a Brooklyn blogger who published jabs against the businessman on his small Web site.

GerritsenBeach.net Attacked by SSJ Development and Jemal family?

On July 18th 2008, my website came under attack from a now known source, which I believe, based on information received, the attacker is CLOSELY CONNECTED to Mr. Stephen Jemal of SSJ Development. Let’s recap.

I posted a story about Mr. Jemal being sued for an alleged non-payment of a loan connected to his real estate projects in our area. I later posted a story about a “DoS Attack” on GerritsenBeach.net after it was contained, informing everyone of the resulting down time. I reported the incident to Verizon, the attacking IP’s owner.

Later that night after the attack, I received a letter via email from Stephen Jemal’s attorneys, demanding that I take down my post, citing defamation. Here is that demand letter.

I believe that the demand letter makes completely ridiculous and unreasonable demands of me and the website, including:

  1. Removing the entire publication about Mr. Jemal
  2. Removing any reference of the publication from Google, all other search engines, and other blogs (like I run Google and control their root user name and passwords!),
  3. Publish a retraction / clarification approved by Mr. Jemal and distribute that throughout the internet,
  4. signing a “non-disparagement” agreement, and… oh yeah
  5. Sign an immediate settlement of TWENTY THOUSAND DOLLARS for legal fees, and additional consideration to induce Mr. Jemal not to file a lawsuit.

Whew! Mr. Jemal’s representation conveyed that the article “painted” him badly. (This Article)

Here is the problem with all of this: What statement did I make that was false? What statement did I make that was defamatory? Oh, that’s right… NOTHING. Needless to say, that demand was flatly rejected.

This is where things take a very interesting turn.

After posting about the DoS attack, I received multiple emails from ####@SSJDevelopment.com stating that he knows that someone VERY CLOSELY connected to Mr. Jemal, used a “bash script” that he had taught this person.

Upon reviewing the website logs, the script described was indeed the script used to attack this website. Based on the connection between the two pieces of information, I have reason to believe the author of the email.

Mr. Jemal’s attorneys have since told me that the attack on the site was the work of a “renegade employee” who acted without knowledge or authorization of Mr. Jemal. They also told me that Mr. Jemal fired this employee.

While I am not in total agreement with this statement (the offensive IP originated from the Jersey Shore where the alleged offender claims to live, not in Brooklyn where this “renegade employee” worked), I accepted their statement. I was also accused of using this information in an attempt to extort a settlement, which I was not doing at all – I was simply adding information to the negotiations, attempting to give all a fuller view of the circumstances surrounding the blog entry, and released the information with no thought to how it would “be painted” or inferred.
