Members of the New York State Majority Conference including Senator Marty Golden (R-C, Brooklyn) today called on the State Assembly to immediately join the Senate in passing legislation (S.391), sponsored by Senator Cathy Young (R-I-C, Olean), to expand the definition of a drug to include glue sniffing or aerosol inhalation within the grounds for drug-impaired driving.
“This bill has failed to pass the Assembly since 2002,” said Senator Golden. “I’m urging the Assembly to close this loophole in the law allowing drivers which are obviously intoxicated to escape criminal punishment.”





There is no excuse why this legislation will not pass. Does anyone know why it did not pass in 2002? What could the reasoning be? Impaired is impaired!!!!

Nick yes there is not excuse for dust off not being passed. I have been dealing with the DA’s office because my son was in one of the car’s on the avnue and he lost his girlfriend Kristian in that accident. I have been informed that Joseph bruno and Sheldon Silver refuse to pass such bill or add dust off tho the driving while impaired. It’s very frustrating to me and my family at this point. I have been doing by best to get anyone is legislation, senators, and etc to help me with this move. But as of now I cannot get any answers from anyone. If you go onto the web there are web site’s for such officials and you can write them. THe more we write them the better chance We can pass a law in Kristian Roggios name. Which would mean so much to me. I want her to live on and no one forget what happened to her that night.

Thank you so much Dara. I have forwarded friends and family members to write both of them, not only with regard to finally passing this law, but a request for a clear, solid explanation why such a loop hole still remains in our laws. I’m baffled how this could fall into the grey world of politics when this is ABSOLUTELY black and white. You can’t get high off of cleaning products and drive a car. Or do both at the same time.
Without even factoring in the most tragic events a family should ever encounter, this should be COMMON SENCE!!!!!!.
…AND it scares me to think that someone can be lifted out of this guilt and responsibility of their mindless fucking actions, and only once again destroy the lives around them.

I have also been doing my own research and calls regarding this. I wanted to find out why the assembly has not passed this bill since 2002.
I spoke with Alan Maisel who didn’t give me much help. He does sit on the transportation committee which where I think the bill keeps on dying.
Alan did say that just because a bill seems like a good idea on the surface that it doesn’t mean that it will work. isn’t this the same people who are fast tracking congestion Pricing? I completely understand the ramification of a law. It has to be sound. Something like adding a substance to a DUI/controlled substance list doesn’t seem like it should take years.

I want to thank you for helping out with our fight on huffing. Kristian was a great person and she would be so happy to know you joined us to help with her cause. Marty Golden was suppose to call me back on this matter and he hasn’t. Joseph Bruno nor Sheldon Silver have answered me at this point. It’s a shame that they could ignore sure a problem with our teen’s and young adult’s. You can stand in the middle of Gerritsen Avenue and huff a can of dust off, butane fluid, diesel gas and they can’t touch you. Why? cause it’s not on the illegal list. This kid is gonna walk free and we have lost someone very precious. You will get more time if you assault someone then he will ever see. We have a law that states in an accident where possible death is involved all drivers must be tested for alcohol and drugs. Unfortunately the police and the investigators do not test for drugs. There is a special test for inhalants but once again the hospital nor the police test for it. Why do we have such laws in place if there not gonna use them. If you put in the search for huffing dust off you will find so many horrible stories of death by either cars, in houses, and in bathtubs. I have read so many and there a tons of stories I have yet to read. But our government still ignore’s the agony of each and every family that are going through this. All they do is sit on there hands on this situation. Every time you turn around they are changing the BAC law on alcohol and the amount of jail time you will sever when a death occurs. If you were caught DWI with a death it once was as follows 1 year in jail and 5 years probation. Then we went up to 7 years in jail and on release probation and now just about 5 months ago it went up to 15 years. But drugs haven’t changed nor have they changed the law to included any and all may they be smoking, inhaling, snorting, or injection be totally illegal. Why does any substance have to be named to be on the illegal list why can’t it just say all or have a line that says other and the DA fills the drug in. Here are some links about huffing dust-off. One link is a police officer who lost his son to dust-off. Other links are stories of car accidents and some kids being charged with huffing dust-off in other states.
I also want to say that Co2, which is sold for paint ball guns are on the illegal list. The guy on the avenue sells these. I wish he would not sell them to anyone under the age of 21. If anyone is under the age of 21 a parent should have to purchase them sign a paper letting them know the danger of them and watch there kids while using them. They should then take them away (the remaining) and hold them to they go paint balling. I am also aware that some kids down here get high off these Co2 cartridges since this accident as well. I am not coming down on the store owner, I understand he’s just trying to make a living. But if store owners take it upon themselves to do this, they might be just saving a life.
