‘HUFF’ AS COURT CUTS DWI RAP

June 28, 2007 — ALBANY – A Brooklyn man accused of “huffing” a can of keyboard cleaner before driving into oncoming traffic and killing a 17-year-old girl should not have been charged with DWI under state law, the state’s top court ruled yesterday.

Vincent Litto was 19 in 2004 when he sprayed a can of “Dust-Off” into his mouth.

Litto’s car veered into oncoming traffic and crashed into another vehicle, killing 17-year-old Kristina Roggio in Gerritsen Beach.

While 12 of the 14 counts remain, including the top charge of second-degree manslaughter, the Court of Appeals yesterday upheld a lower-court ruling throwing out a DWI charge on the grounds it can apply only to cases involving alcohol.

State law does have a charge of driving while ability impaired by drugs, but even that didn’t apply because “Dust-Off” is not among the drugs referenced in the law, the court found.

    I’d like to start out with Thanking The Editor of the GerritsenBeach Net for posting this info because if it wasn’t for your continuous Update in this case I would not have known of this information. I should have been notified about this from the Direct Attorney but somehow we failed to receive this important news

    I think it is absolutely amazing how after 3 years 5 months and 17 days has past since the accident
    Vinny Litto has not spent one day behind bars & is free to walk the streets while Kristian gets to spend her’s days 6 ft below.

    If he is not guilty of DWI then he must be fully responsible for his actions & then it must be murder & why isn’t he behind bars where he belongs.

    When someone kills someone they are immediately arrested & incarcerated for a time when and if bail can be set for their release.

    In Vinny’s case we watched him recover at home from his injuries & schedule a surrender months later.

    His scheduled early morning surrender, allowed him to be quickly processed thru the Pct & Central Booking in enough time to make it to his court appearance that afternoon where his bail was set & ready for his immediate release.

    Huffing is a growing problem in this country it’s not just here in NY it’s all over. The subatances these kids are using to get high off of do not show up during a field breathalyzer or in normal drug testing additionally even if it did the substances are not illegal to posses or consume while operating a motor vehicle.

    Our legal system is failing us here & I truly fear as the updates in this case continue to be reported over the next several years Vinny Litto will still be walking around freely & no justice will be served for Kristian Roggio

    Even though there are still 12 more charges to be brought against him I do not believe a sentence will be served for any of the charges that are being brought against him. I honestly believe that in the end his sentence will possibly be 72 hrs of community service & probation.

    Vinny Litto has single handily destroyed the lives of 2 families the Roggio’s & Mine, countless numbers of friends to Kristian & our Legal System sits idle & lets time go by

    People need to become aware of these hole’s in our laws & write your senator, congressman or anybody else you can think of about them to get this law changed to include huffing as an other form of DWI.

    The person it may help save just might be one of your family members

    Vinny Litto is not a murderer. I feel for Kristina and her family but Vinny is NOT a bad person. He wouldnt ever intentionally hurt a fly! I have known him my whole life and for someone who had a hard life as it is, he was always as gentle as possible. When you are a teenager living in a neighborhood where all of your peers do drugs and drink, and have almost no family around you, one becomes an outcast if you dont follow your peers. Yes, a 19 year old should have known better, but if this started at a young age, it is extremely hard to break the habbit. Vinny may need help becoming sober, be he is no murderer. It was an accident and im sure Kritsina knows that. May she rest in peace and may her family find peace.

    He is a murderer, pure and simple, anyone who does anything that intentionally impairs their driving and kills someone is a murderer. Stop blaming other people and start taking responsibility, by the way and you aren’t sure Kristina knows that.

    Thanks to this loser she will never know a lot of things, she will never know what it will feel like to get married, have children or grow old, her parents will never know their grandchildren or see their sweet daughter’s face again. I don’t feel sorry for Vinny, he is a typical example of how the system fails us, he is not the victim here so stop trying to make anyone accountable except him.

    We as a community have a right to know such things and it’s called freedom of speech, this girl’s family have a right to have the truth out there and see how what a joke and a miscarriage of justice this is that this creep is walking around while that young girl is dead. He’s not as harmless as a fly, flies don’t drive into oncoming cars and kill people. He should be off the streets where he can’t kill anyone again with his stupidity.

    There is such a thing as Karma and he’s going to get it, hopefully he will overdose and do society a favor.

    We aren’t a bunch of old women gossiping, we are a concerned community who needs to know what is going on and not brush these things under the rug so a loser and his mongrel family isn’t embarrased, how outrageous to say such a thing.

    Keep up the good work Gerritsen Beach.net, I love this site, people just can’t handle the ugly truth. Deal with it and take responsibility and stop making excuses for loser behavior.

    I’ve also known Vinny for a long time; his father is one of the most outstanding men I’ve met. I know how hard he worked to provide for Vinny, and I know how difficult it was doing that without a wife (who passed away when Vinny was an infant). Vinny’s father set a high moral and ethical standard for his son, and Vinny did his best to aspire to that standard. Unfortunately, as evidenced by this tragedy, he didn’t always meet the expectations set upon him.

    The Anonymous comment from January 27th just missed targeting the bigger issue: there is, and always has been, a rampant abuse of narcotic and alcoholic substances in Gerritsen Beach. Most of the people my parents’ age smoked Marijuana, and now most of their kids do as well. Growing up playing basketball at the park near 277, I saw an entire community of teenagers who consumed shrooms, smoked pot, huffed paint behind the handball wall, and many more who did worse for themselves in the weeds.

    The truth of the matter is that Gerritsen Beach, for all its beauty, is as much a small town (it could easily transpose itself to any Midwestern state and fit right in) as it is a part of Brooklyn. As such, it has to deal with the same things that a small town does: close-minded people (hence the atrocious racism that stains its population); gossips who have nothing better to do than to gab about the lives of others; bored youth who have nothing to aspire to beyond the civil labor that the majority of their parents engage in. How many writers and doctors does Gerritsen Beach produce? Is it comparable to the number of firemen, police officers, and sanitation workers?

    Gerritsen Beach is as blue-collar a community as they come, and that’s what makes it special and unique, especially in the twenty-first century; it’s a gated community in which the restrictive bonds are cognitive rather than corporeal. The point is that Vinny’s story is an extreme example of something that goes by unspoken of on a daily basis. If you want to chide him for getting high and doing something stupid, be sure to look at your own past first. If you’re from the Beach, the odds are that you, or someone close to you, has done something similar in your lifetime. Something shouldn’t be done about VINNY, but about the endemic issue of a youth lacking vision and a solid example from which to build an emotional and ethical foundation. Has anyone been to Resurrection lately? If not, go to a mass on Sunday. Don’t bother bringing paper and a pen, you can do a headcount on your fingers and toes.

    In my opinion, people are afraid to talk to their kids about the obvious abuse of drugs and alcohol because they know it would be hypocritical of them to do so. How could they chide their kids for getting high when they did it themselves twenty years ago? (…or still do today?) There needs to be more discussion about this on a wider scale. Instead of making Vinny into a pariah, let him serve as the starting point for a conversation that NEEDS to happen about drugs and their impact on kids.

      I have never read anything on this site that was as well spoken and SO ON THE POINT.

      Yes, we have had a drug problem down here since the days the library was on Everett & the junkies took over the corner at 6PM. How was that dealt with? We weren’t aloud up the avenue after 6PM, it was easier than trying to clean up the corner.

      I wish there was an answer to this age old problem. The main differnece from then til now, most people didn’t have parents buying them cars, if they were junkies they didn’t waste money one something liek a car so less driving while high.
      This is definately a tragedy all around.

    First things frist her name was Kristian NOT Kristina…. At this point I dont even know how to feel about this stiuation, Kristian was more than just my BEST friend, she was such a kind harted person with so much love and energy that she loved to share with everyone that crossed her path. I think that Vincent Litto deserves to be behind bars for what he has done, we understand that he did not just wake up on the morning of January 13th 2004 and decide to kill my bestfriend but he DID make a conscious decision to buy a bottle of dust off and inhale it not knowing what the consequences would be…. And unfortunatley for those of us that LOVE her & MISS her dearly, his Stupid decision resulted in a great loss for us…………

    I too knew Vinny & his Father and I can’t begin to tell you how many times that kid sat at my dinning room table while my wife helped him do his home work with my son & and afterwards they ate Franks with Mac & Cheese or whatever else she was making them to eat.

    That kid was at my house more times eating & doing his Home work than I can shake a stick at. So you can only Imagine how disappointed I was when on Jan 13, 2004 he killed Kristian & almost Killed my son James & Andrea not to mention his 3 friends he had in his car

    His Father was only conserned about himself and no one else !!!

    Vinny’s Father dumped him off on anyone he could just so he could go about his everyday business whatever that may have been. Yeah it must be hard to raise a kid without a spouse but there’s an awful lot of single parents doing it out there & their kids grow up with morals and proper values

    AS FOR High Expections – Your Kidding me right! He never strived to live up to any higher standards his Father set for him. That kid had a Rap Sheet longer than 25ft tape measure I saw It in the 61 PCT myself …. so much for the model citizen of the year or lifetime achievement awards for him.

    Get off the boat & face it the kid was a PUNK his Father had no way of handling his own son nor did he want to his only concerns were his financial well being after his under 21 aged son who still lived at home with him was going to get affected after Vinny’s encore event on Jan 13 2004.

    Don’t go blaming everyone who smoked pot and did other drugs as kids for what Vinny did that night. Gerritsen Beach does not breed these types of characters.

    Their grown & raised in their own homes unfortunatly there’s just too many I don’t care what my parents have to say kids in the streets following what the other kids are doing & when they come home their parents have no clue what their kids were up to

    So don’t blame the parents because most aren’t to blame

    As for the Church I don’t blame the people for not going. The place is a joke anyway I would just as well go to a church in another parish before go to that one.

    As for Vinny, his day in court will soon come. And on that day whatever the courts give him as a sentence will not be long enough because him and his family believe in Zero Accountability For His Actions in this case I guess they feel their above the LAW !!! but Surprise Surprise Their Not !

    It’s been almost 5 years of living in pain for the family & closest friends of Kristian and there has been no justice or no closure to this. However there seems to be no shortage of Vinny Simpithisers out there.

    But let me tell you this, when he does get sentenced and that day will come and he’s doing his time I will be there at everyone of his parole hearing explaining why they should let this bastard rot in Jail and do his Maximum Time Given To Him!

      I knew Kristian and your son from the nail salon, she was a wonderful young lady with a whole future ahead. I saw them both at the salon and they seemed in love, a light has gone out and for Kristian’s family as well as your family I am sorry, I also know your wife who is an awesome peron as well.

      It’s amazing how people can’t accept responsibility and try to play down something that wasn’t intentional but horrific and sweep it under the rug. Her parents will never get over it, your son will never get over it, you don’t get off that easy and so shouldn’t good old Vinny, maybe some jail time might be good for him, his friends and family sure aren’t. Karma is a b*tch and he has it coming big time.

      True, Vinny made his choice that night but wow, seriously? Gerritsen Beach does not breed these types of characters? What neighborhood did YOU grow up in pal? In the early 90s a black family tried to move into the old section and their house “mysteriously” burned to the ground shortly after they moved in. Ever hear someone say the word “Nigger” in Gerritsen Beach? If not you must’ve had your ears plugged! There are plenty of characters that come out of Gerritsen Beach, believe me. This kid lived there for how long? Ten years? More? How long does it take for your neighborhood not to help breed who you are? Nobody’s excusing this kid pal but you’ve gotta take a more serious look at what’s going on around you

      I apologize for inciting your rage with my comments from a few months ago. While I do not understand what relevance my identity has to the issue at hand or why posting as “Anonymous” as five other people have would render me a coward, I DO understand many of the viewpoints that you expressed. Regarding Vinny’s character, as well as his father’s, you have to realize that I was simply speaking from MY perspective, not yours. My interactions with Vinny occurred well before our teenage years and my interactions with his father were not as extensive as yours seem to be. I would not say that either of us is in a position to cast moral judgement upon either man but we are each undoubtedly free to subscribe to our own views. The bottom line is that my comments were not meant to elicit your ire, nor were they meant to be combatative; I merely gave MY take on the men.

      I apologize if you misconstrued my original comments about the drug situation in Gerritsen Beach. I never meant to imply that the “bigger issue” is what caused Vinny to do what he did; it was his own poor judgement that did that. What I was trying to say was that rather than focusing ONLY on this situation with Vinny, the bigger issue should be addressed to avoid future tragedies. It’s too late for those who were lost in this instance but perhaps if more education is provided to the community about the dangers of ALL types of drug use then there would be less of a chance of a repetition of this situation.

      I wasn’t really clear on what you meant by this but if I understood you correctly you basically said that the parents have no idea of what their children are up to and this thus exonerates them from blame? I cannot agree with that point because were these parents to make more of an effort to be involved in their children’s lives then perhaps they WOULD know what was going on and would have more of an opportunity to do something about it. That was precisely my point: there is too much “looking the other way” in our neighborhood.

      Again, I believe my point was misunderstood. The Resurrection issue is two-fold. My parents, and their parents, and THEIR parents were all parishioners at the church; this is true of many families in the beach whose generations span back well before the 1950s. The church once had a fervent following and was respectable. The fact that, “the place is a joke anyway” just goes to show you how far it has fallen. My problem with the church is entirely with the hypocrisy that pervades the congregation, at least from my perspective. I grew tired of seeing these teenage girls giving oral sex in the park or in the back weeds and then seeing them on the bus the following day and watching them kissing the crosses they wore and blessing themselves repeatedly. As you said, Resurrection had become a “joke” and that bothered me. Unfortunately, this is something that I’ve struggled with for years. I’m in no position to judge these people and yet that’s exactly what I’m doing; this is my own demon that I must tackle.

      As for Duder742, while I wouldn’t condone the use of language like that, it HAS become more prevalent; if you’re talking about the kids, it’s probably something they’ve picked up from friends or at school. As for the example of the house burning down, have you walked around the neighborhood at all lately? I have seen plenty of people of other ethnicities in the neighborhood; none of them seem to be in any danger. For the record, Gerritsen Beach has bred a number of GOOD people; do you think it’s only “these types of characters” that come from there? For all its faults, Gerritsen Beach is one of the best places to live in New York. As a kid I never had to worry about getting shot when I was leaving my house, I never had to be afraid when I walked around at night; I was able to go to the store with money in my pocket and not be afraid of being robbed. Personality traits aside, Gerritsen Beach residents are not a bunch of murdering racists, they’re hard-working people who are trying to enjoy their lives just like the rest of us.

      Finally, Mr. Di Siena, it is a shame that it has been this long and justice has not been served but at the same time, it sounds like many of the people affected by this situation have not found their own justice. I understand the heartache that everyone is going through but waiting for an ounce of flesh from Vinny won’t bring anyone back or undo the pain that’s been caused. I’m sorry that you and everyone else had to go through all of this and I apologize if I added to your grief with my thoughts about Vinny. I didn’t intend to align myself with one side or the other, I was just offering a viewpoint that hadn’t been expressed on this page.

    Mr. Di Siena, I did not mean to offend you in any way. I had made my comments based upon my own experiences with the Littos and, admittedly, those experiences came when I was a child. I did not have the benefit of an adult perspective on the behaviors of either man and was thus coming from a different place than you. Please accept my apology as I did not mean to contribute to your grief; I simply wished to express a viewpoint that I did not feel was adequately explored on this site.
